The driver of the trailer truck from which a container fell on a car, injuring its driver, will face both civil and criminal actions, said Kamol Buranapong, deputy director-general of the Department of Land Transport.
Mr Kamol said Viset Nakornchai, 61, the truck driver, had been invited for interrogation.
As for the civil action, he is liable to compensate for the damage made to the car and the injury to the driver.
In the criminal action, Mr Viset stands to be charged with violating Section 71 of the Land Transport Act of 1989 regarding transport safety. According to the law, a truck for transport work must be of a good condition with proper equipment and accessories.
From initial checks, the container was found to have not been properly affixed to the body of the truck, causing it to fall onto a car which was driven by Sermpong Piriyanupong, a 59-year employee of Bank of Ayudhya, who was slightly hurt in the left arm.
He was taken to Kasemrad Rattanatibet hospital for medical treatment.
The accident occurred at 2pm on Dec 27 in Nonthaburi’s Plaibang district at the exit ramp of an interchange to Kanchanapisek road.
